We first try to resolve employee-employer disputes through negotiations aimed at producing settlements that are fair to our clients and acceptable to their employers. When the client wishes it, the firm participates in mandatory or voluntary arbitrations and mediations, with court-appointed third parties, retired judges or privately selected facilitators. We are all too aware of the costs and pressures of trial, with the attendant emotional hardships on individuals having to repeatedly re-live work experiences they would much rather leave behind; and so we strive to avoid litigation where a negotiated settlement can provide a non-adversarial but fair outcome.

There are occasions, however, when negotiations are not successful. In such instances, and when our clients agree, Zuckerman & Fisher, L.L.C. is committed to aggressive pursuit of claims through litigation. Ms. Zuckerman is also admitted to the bar of the U.S. Supreme Court, while Mr. Fisher has filed amicus curiae briefs in the U.S. Supreme Court in matters on which that court issued full opinions. By reason of their former duties in the New Jersey Attorney General’s Office and their practice in employment law, both have levels of appellate experience many attorneys never obtain.

We also encourage employees with knowledge of illegal activities by their employers that cost federal or state taxpayer dollars (e.g., Medicare fraud, inflated charges to government for supplies and parts, etc.) to contact our firm. Where permitted, we pursue qui tam actions against the employers to secure monetary recoveries that benefit not only the government but also the employees bringing to light such activities.
